Maryann L. Nergaard, J.S.C. (Ret) OF Counsel

Judge Nergaard joined Daly & Associates following her retirement from the bench in the Morris and Sussex Vicinage, where she served in both the Family and Civil Divisions. She provides mediation and arbitration services, as well as consultation services to attorneys outside the firm, in her Of Counsel capacity, regularly consults with lawyers in the firm, and is particularly skilled in handling complex and difficult family and commercial matters. Her diverse background in the law, in business and in life assists parties in reaching reasonable and practical resolutions of their disputes.

Prior to her judicial appointment, Judge Nergaard was a member of Woolson, Sutphen, Anderson & Nergaard, a general practice law firm located in Somerville, New Jersey, where she regularly represented numerous municipalities and other public entities as general or special counsel. She also represented community associations, small businesses, non-profit organizations, and individuals in matters such as residential and commercial real estate, real estate taxation, eminent domain, land use applications, contract negotiation, and will drafting. She served as a municipal prosecutor and also handled guardianships, labor and employment contract negotiations and litigation, will contests, shareholder disputes, and small business dissolution litigation.

Judge Nergaard has a diverse background which provides her with unique insight into clients’ needs and concerns. She attended law school at night, graduating in three years while working full-time for Allied Corporation (now Honeywell) in the Corporate Law Department. Prior to attending law school she had a successful sales and marketing career with Xerox Corporation, which she joined after serving as a reference librarian at Kean College and the Morris County Free Library. Her diverse experience enables her to understand complex issues and to empathize with clients during stressful times.

As Assistant Morris County Counsel, she provided general advice and representation to the County Freeholders and to several County Departments, including the Department of Human Services in collection and welfare fraud actions, fair hearings, and child support matters brought by the Office of Temporary Assistance involving public assistance recipients and out-of-state parties in Uniform Interstate Family Support Act (U.I.F.S.A.) hearings. She also represented the Morris County Open Space Trust Fund, reviewing grant applications and providing general legal advice. She served as attorney for the County in numerous condemnation actions and in civil commitment hearings.

Judge Nergaard served as a member of the District XIII Ethics and Fee Arbitration Committees, as a member of the Somerset County Bar Association, the New Jersey Institute of Local Government Attorneys, and the Supreme Court Tax Court Rules Committee. She was active in the New Jersey State League of Municipalities, serving as Associate Counsel for over 20 years, and as Legislative Committee Co-Chair for over 5 years. She was a member of the Long Hill Township Committee from 1993 to 2004, serving as Mayor in 1996 and 1997, and Deputy Mayor in 1995 and again from 2001 to 2003. She also chaired the Long Hill Township Environmental Commission from 1990 to 1992.

Judge Nergaard is a member of the Morris County and New Jersey State Bar Associations and previously served as a member of the Morris County Bar Association Committee on Professionalism, the Supreme Court Special Civil Part Practice Committee, and the Supreme Court Model Civil Jury Charge Committee. She is a member of the Justice Marie Garibaldi Alternative Dispute Resolution Inn of Court. She is an honors graduate of Drew University, which recognized her with an Alumni Achievement Award in 2016, of Rutgers University where she received an MLS, and of Seton Hall University School of Law where she earned her J.D.
